  1. Determine Eligibility: The beneficiary evaluates their eligibility for a National Interest Waiver based on exceptional ability in the sciences, arts, or business, or for having an advanced degree and that their work is in the national interest of the United States.  

  2. Gather Documentation: Gather evidence to demonstrate exceptional ability or advanced degree qualifications, and that the proposed project has substantial national merit and significance, is well-positioned to advance the project, and that it would be beneficial to the United States to waive job offer and labor certification requirements.

  3. Prepare Form I-140 (Immigrant Petition for Alien Worker): Complete the Form 1-140, including all required supporting documentation. This form serves as the petition for a National Interest Waiver.

  4. File Form I-140 and Supporting Documentation with USCIS: File the petition along with the supporting documentation and filing fee at the appropriate U.S. Citizenship and Immigration Services (USCIS).  

  5. USCIS Receipt Notice: After filing, receive a receipt notice from USCIS that acknowledges the filing of the Form 1-140 petition. 

  6. Processing by USCIS: Wait for USCIS to process the NIW petition. This step involves a review of the submitted documents and may include requests for additional evidence (RFEs) or an interview.

  7. USCIS Decision: Receive a decision from USCIS on the NIW petition. The decision could be an approval, a request for additional evidence, or a denial.
